KERRY SIMONS and ALLEN MORENO, Individually and as Representatives for all others similarly situated and the General Public. This is a national class action against:

HEWLETT PACKARD COMPANY, COMPAQ COMPUTER CORPORATION

on behalf of those who allege claims for unlawfully imposing sales tax on thousands of unsuspecting California consumers, who separately purchased optional maintenance agreements at the time they purchased computer equipment designed/ manufactured by Hewlett Packard Company. Hewlett-Packard, who acquired Compaq Computer Corporation in 2002, is listed in the top 20 of the Fortune 500 companies. The suit asks for punitive damages, cypres recovery, permanent injunctive relief, compensatory and consequential damages suffered by Plaintiffs and the members of the Class, exemplary damages, restitution and disgorgement of money received by Defendants as a result of their wrongful conduct, attorneys' fees, pre-judgment interest, and costs of suit.
