SBC IP COMMUNICATIONS, INC., YAHOO! INC.

on behalf of all those who allege to have purchased the SBC Yahoo! DSL service and were unaware of the fact that the SBC Yahoo! DSL capabilities they purchased were of degraded quality because of their distance from the DSL "hub". SBC and YAHOO deceptively represented to Plaintiff and the Class that if they purchased the SBC Yahoo! DSL service, they would be provided "the very best broadband Internet experience around." The suit asks for an equitable relief, injunctive relief and declaratory relief; punitive damages, exemplary damages, consequential damages, compensatory damages, cy pres recovery, restitution and disgorgement of money received by Defendants as a result of their wrongful conduct, attorneys' fees, pre-judgment interest and costs of suit.
